    I applied for new (CAP) H1b in April 1 2013 and recently got denial letter. What are the options left? Can another employer file my H1B without CAP? I am already inside the country in H4.

        If petition itself was revoked by USCIS, then you have to apply in new cap. What was the reason for denial?

          Thanks for the response.
          Petition was denied. Does it mean it is revoked? What if i file for MTR and while MTR is in process can Company B apply for new H1b for to start working right away instead of CAP?

            Filing an MTR doesnt maintain your status. You need to talk to a good attorney who can look at the paper work and suggest accordingly.
