  • How H1B Visa process work in my situation

    Hi,

    I got my H1B, which is approved till Nov 2013 (Validity given for one year only which is mentioned in the passport stamping)

    1. As per my understanding my visa validity is over is that right?.
    2. With this visa i did not travel to USA even once.

    I like to know few details, please share the information.

    Questions:

    1. Does this Visa will be used further? or do i need get new H1B Visa?
    2. I got the information from my company that Amendment can be done (which is not expensive like getting fresh H1B) to make use of this visa, is that right?
    3. If i moving to new company, can this visa will be used or not?
    4. Is there any chance i can think of USA with this visa?

    Experts please share your experience in the above situation...

    1. Once the Visa expires you have to get a new one.
    2. Yes.
    3. As said, visa is expired but petition is valid, so yes any other company can file a cap exempt new petition for you and you need not wait till April, and once that petition is approved, you can use the new petition to go for new visa stamping interview along with other relevant documents.

      Please clarif the below,

      One thing i understood is that i will not come under the regular cap.
      You said that Visa is expired but not the petition, in this case how are you saying my petition is valid?

      ---I have form named as I-797B in the top right corner. which has the details as follows:

      Notice type : Approval Notice
      Class : H1B
      Valid from 11/05/2012 to 11/05/2013
      Consulate : Chennai.

      What you mean by this?...is this a petition validity? if not let me know question follows

      1. How and where to verify the petition validity?
      2. What is the default petition validity duration?
      3. How much it cost for applying new visa?
      4. How much it cost for Amendment?
      5. Do i need to apply for Amendment or New Visa?
