H4 to H1. Which process to go for COS or Consular?
Hello,
I am currently in the USA on H4. My husbands H1 will be expired in Jul 2014 though he would be applying for an extension.
My employer in India want to file my H1 for Apr 2014 but in order to work from Oct 2014, I need to get trained in India for few months from May 2014.
1. Can my employer apply for my H1 using consular process while I am in the USA on H4 in April 2014?
2. Can my employer apply for my H1 using COS process while I am in the USA on H4 in April 2014?
3. In both cases, I assume that I cannot enter USA unless my H1 is stamped in India. Is it right?
4. In whatever condition, and though wherever I am, will my H4 get automatically extended with my husbands H1?
