I have a unique situation, its a very tricky case:
Background:
Left Employer A to Join Employer B.
Employer B has filed for 7th year H1b transfer based on prior GC filing on November 2013 (I joined Employer B on 1st Dec 2013). Meanwhile, Employer C from India offers a job offer on March 15, 2014 to join them on April 30, 2014.
My Family petition is in process at the same time (its 6 years through now, may take another 5 years).
Questions:
1---I want to return to India and work for Employer C, but my worry is that if i leave employer B while transfer is in process then will my current stay in US (Dec 2013 till now) be invalid/out of status? I have no documents from Employer B to prove that they filed my transfer etc (they are not giving). I want to keep my immigration status clean, just in case after 5 years my family petition, which is presently approved but is in waiting for date to become current.
2---If i sign the offer agreement from Employer C to join them in April 30, 2014 as a back up plan (as i really want this job and dont want to let go the chance but want to wait till Employer B gives the H1b transfer papers before leaving Employer B) or if I dont get the H1b transfer papers from employer B and i decide not to join employer C because i dont have H1b transfer papers from employer B, then will company C take action against me for breaking the agreement of job offer in India and take me to court?
