Fresh H1-B 2015 - Documents already sent by my Employer - Employer has no Petition no

  • Fresh H1-B 2015 - Documents already sent by my Employer - Employer has no Petition no

    Dear Friends,

    I am currently working on L1-B Visa. I had found an employer to Sponsor my Fresh H1B Visa. There are some questions about the Fresh H1-B mentioned below,

    1) Employer Says the Documents are already sent for my Fresh H1-B Visa. Ques - For Fresh H1-B 2015 Visa does USCIS accept filing before April 1,2014?

    2) Employer Says that he has Does not have the EAC/Receipt number for the petition he has filed. Ques - Can this be true?

    3) Employer Says that it takes approximately 1 month for USCIS to provide information if the petition is selected in lottery. Ques - Is this correct?

    4) Employer Says that he has sent a Draft check of Amount $4400. Once the amount is en-cashed it means that H1-B has been selected in lottery. Ques - Is this correct?

    5) Employer Says that once the H1-B selected in Lottery I will get the Petition number. Ques - Is this correct?

    6) Employer Says the status of H1-B can be found out only after its selected in lottery. Ques - Is this correct?

    It seems you dont trust your employer much.

    1. Sent to? USCIS would accept only from 01-Apr-2014. The documents should most probably be on their way.
    2. Yes. Receipt will be generated later on.
    3. Yes considering that a lottery is a possibility.
    4. Yes, if not selected in lottery the money will be refunded. Its illegal to pay for ones own H1.
    5. Yes.
    6. Yes.

      A) My Employer said that once the petition is selected in Lottery then only it can be upgraded to Premium Processing - Ques - Is this correct?

      B) My Employer said that Premium Processing fees can be paid by me online - Ques - Is paying the premium processing fees by me Legal?

      C) I did not sign any documents while filing H1-B 2015. I was concerned if this is correct procedure?
