  • Switched Employers in USA: H1 stamping required if travel to India..?

    Hi Team

I was employed with Employer A ( H1 Visa stamped till Sep 2015)and switched to Employer B. I have to go to India for an urgent family matter. Do I need to have my H1B stamped again..? I have a valid I-797 approved for employer B.

    Appreciate your help.

    Regards,

    Saurabh

No..not really and you can return back as the visa still valid until 2015.

    This is my opinion.

Switched Employers in USA: H1 stamping required if travel to India..?

      Hi,

I had a similar situation couple of years ago and I travelled with the Employer A's visa and showed Employer B's I797 at the point of entry.

While I booked an appointment at the US consulate in India, I cancelled it.

Before I cancelled the appointment and travelled back from India, I contacted the Attorney of Employer B and the Department of Homeland security to make sure that it is valid.

Further to add, a H1 Visa is required to travel to the US and a valid work permit (which is the I797) is to enter the US.

      Hope this helps.

Note : This is not a legal advice. Contact an attorney and confirm.
