Hello,
My wife entered the US with her H4 Visa after my H1B was adjudicated to Green Card status, we applied to the I-485 once in the USA but it was rejected because the priority date is not current. I don't understand why they rejected the application considering we got married BEFORE I adjudicated to GC status. From what I've been able to read we could file the I-824 to apply to a following-to-joint immigrant visa at a consulate overseas, except that she is already in the USA. I don't know what to do?
I appreciate any help or ideas.
