Original documents of I-797, I-129 and LCA required for H4 stamping?

Hi Friends,

I am H1B visa holder living in US for the past 5 months. My wife is going for stamping soon in Nov at chennai consulate. Do i need to send he the originals of I-797, I-129 and Labor Condition Application ?

Does any one heard or experienced a situation where H4 visa is refused just because original copies of I-797, I-129 and LCA is not produced?

Hi,
According to the VFS rules, original I 797 is a requisite. You will however not have original I129 and LCA, as the same would have been submitted to USCIS for the H1B approval to come through. So do send the original I 797, though I have not heard of any H4s being rejected due to non-production of the same. Just advising you to take the safe side.
