  • My H1b 2015 petition was approved. and What would be the next step after h1b approval

    Today(23-May-2014) My H1b 2015 petition was approved.
    What would be the next step after h1b approval?
    Can i go for stamping immediately after receiving I129 and I797 documents?
    Or is there any time constraints for H1b stamping?
    Imp dates as per h1b receipts.

    Notice Date : 21-Apr-2014
    Approved Date: 23-May-2014(Post Decision Activity status)

    Not so early.

    You can apply for an H1B visa up to 90 days in advance beginning of employment status as noted on the form I-797, Notice of Action, however your entry to the US is restricted to 10 days prior to the start date as noted in the Form I-797 unless you are already working on an H1B visa and have applied for a revalidation.

    So in case of start date being 01-Oct-2014, earliest you can go for stamping is say July 1st Week of 2014. And earliest you can enter US is Sept 21st 2014, and earliest you can start work is 01-Oct-2014.

        How many days it takes to receive I-797 approved papers

        Have you received I-797 approved papers from your employer/attorney/petitioner? If yes when, after how many days of approval?
        Without these papers you can not schedule Visa interview as per my knowledge.

        Requesting everybody in this forum to share their experience on the time between H1B approval, status "Post decission activity" to approved paper received from USCIS/NVC.
        How many days it takes?

          Hi Prosoon,
          Even my petition / case status is showing "Post Decision Activity", don't know how many days will it take to reach the regional visa center to get all the documents from USCIS.

            Did you guys recieve the i797 yet?
            if yes, then how many days it took to come to you ?
            Mine was approved on 23rd June, but it is still showing Decision.

                I797 update?

                Hello All,

                I heard from my employer in USA that I have been selected in lottery quota for H1 and they will update me when they have copy of 1797 / approval. I have not heard from them yet and they asked me to wait since USCIS is running late.

                Please let me know what shall I do and what could be next step?

                  Ask the employer for the receipt number. With the receipt number, you can track the status of your case online at USCIS website.
