  • H1B validity

    Hi
I got my H1B approved in Nov 2010 and I entered US in Jun 2012 and got renewed at 2012 which is expiring on May 2015. Since H1B can be renewed till 6 years, do i need to consider from the time it approved or date I entered into US. Please advise.

    Regards,
    Vijay Gopal.

Only time you spend in US on H1 status counts towards the 6 Year limitation. But yes, you would have to apply for extension before your current I-94 expiry and tell USCIS that there is still time remaining on the H1 based on your entry/exit and valid time spent on H1 records.

This is my opinion not legal advice.
