Hi All,
I need some help understanding what my employer told me regarding reapplying for H1.
-- I have approved I-140
-- I have Canadian PR
-- I moved to Canada in May 2014 to be able to maintain it as there is 2 yrs residency requirement.
-- Until May 204, I was in US for total of 8 yrs on H1b
-- GC is stuck in Eb3
-- my employer allowed me to work from Canada remotely and told me that once i finish 2 yrs of mandatory Canadian residency requirement, i can come back to US on H1 again.
-- I-797 and my current H1 is / was valid till Jan 19, 2015 (valid visa stamped in my and my wife's passports)
my employer told me that when they re-apply for my h1b 2yrs later, it will not be counted towards the yearly 65000 quota...
this is the part that i did not understand...
anyone has any idea about this process /situation...why will reapplying H1b not count towards this quota...
