    Greeting Members,

    i have found your responses are really valuable. I am very confused. I am on H1 Visa and i want to file h4 application for my spouse. Right now he is holding Indian passport but in october he will become Australian Citizen.

    my Questions are:
    1) Would it effect his application because soon he is changing his nationality?
    2) How long does H4 application take?
    3) Should we wait for his Australian citizenship and then apply for Dependent Visa?
    4) Does gender effects Dependent visa approval.( means he wont be able to work there on dependent visa. Do VO can think how come a man would not work there?

    Please direct me what would be better option?

    Did you apply the visa for your husband? Did you people go together for the visa?
    What questions did they ask your husband?

        As far as I know, India does not recognize dual citizenship. So even if your spouse gets H4 visa on Indian passport, as soon as he gets Australian citizen ship he would have to relinquish Indian citizenship as well passport, thereby nullifying the visa too. So would advise going for H4 with Australian passport in Australia.
        As for gender bias, there is no such thing, there is no harm in husband not working. if your husband tries to work, it is his risk and illegal to do so.
