  • Regarding H1B and H4 visa

    Hi All,

My fiance is holding a student visa in California. He got his H1B visa approved and would be getting visa stamped during Dec which would be coinciding with our marriage.

I have few questions related to same. Can you please suggest the answers:

1)Can we both apply the visa at same time. My fiance for H1B and me for H4
    2) When can I apply for H4. Is it necessary that i have marriage certificate in hand before applying.
    3) How much time this processing will take.
    4) What address will be given in application . My home address or spouse home address. In passport, my home address is given.

    1. Yes, but you have to get married first to be eligible for H4.
    2. You should have the marriage certificate with you.
    3. The time it will take for marriage and get the certificate + 10-15 Days to book appointment and go for interview.
    4. Either is fine. Keep it same as passport address.

This is my opinion not legal advice.
