H1b cap exempt or not ?

I-797B petition was valid from 10/01/2008 to 09/01/2011. I got the H1b visa stamped but has never travelled to the US on H1b visa till now. Now the petition and visa both are expired.
If I want to apply a H1b petition again now, will I be cap exempt. If yes, how many years the I will be eligible for working on H1b further ?
