Do I come under cap again if my extension gets rejected

Hi

How are you doing!
I'm on H1-B, and I have H1 transfer now. I'm going to India in Feb where I need to go for stamping again ( As my old stamp is expired).
I have a qn. Just in case my H1 gets rejected ( during the interview), and if I find another employer who is willing to sponsor me, can I use the same old petetion and do a transfer? Or will he have to file for H1 under cap (like a fresh H1 where it goes for a lottery, etc)
