I came to USA on L2 visa as dependent of my husband who was on L1B visa.He recently COS from L1b to H1b effective OCT 2014.I have applied for COS to H4 on Sep 2014 and still waiting to hear from USCIS.Due to a family emergency i have to travel to india now and am planning to come back in March.
My concern is My husband has approved H1B which is not stamped yet? so the question is Do i have to go for H4 visa stamping interview in India or can i send my passport to VFS for stamping as it is not a new dependent visa but COS from L2 to H4. AND If i have to go for visa stamping interview then do i go as fresh first time H4 visa candidate or COS from L2 to H4.
In other words, What is the process with pending H4 COS?And Will Unstamped H1b cause any issues for my H4 visa stamping.
Also my other concern is Should i wait till i get approved COS from L2 to H4 from USCIS or can i travel now with I539 reciept?
