H4 and I-94 Expired..

Hi,

My wife got her H4 Visa and I-94 stamped till December 31, 2014. I got my H1B extension till September 2017 and forgot to file her H4 extension. She is out of status since 1 month. I have contacted my firm lawyer and awaiting their response. Will she get her approval if I apply for her H4 extension now? Does she need to get out of country and re enter with valid H4 Visa? Please advice.
