I have applied for my H1b Extension on Sep 2nd 2014 by regular process. Since they was not update on my extension, I move my case to premium process on Jan 13 2015, thinking that it should be done within 15 days. But still no update on H1b extension.
When my lawyer contacted the USCIS, they said that the premium fee will be reimbursed as is was beyond 15 days & my case is under security check (or some fraud check) & no date was given on the processing time.
My company lawyer is telling me to find a NEW employer & do my transfer ASAP. My transfer case may get approved.
According to him my case with current employer is under some security check (or some fraud check) may take more than 3 yrs. He told be about 240 days rule too, which I was not aware.
This is my NEW H1B which I got in 2010. I am on my 5th year, so far I did not file for my GC yet.
(I had an old H1b from 2005 to 2006 for 1 year & I went back to my county in 2006 & can back to US with a NEW H1b in 2010 )
My Question
1. Should I still wait for my extension with current employer, as it been 5 months
2. Is it good not find a a NEW employer & do a transfer ASAP , when my current extension is pending ?
3. What is this 240 day rule ?
4. Should I leave the country after 240 days ?
Really worried now, Please let me know what are my options now, as I don’t have much time.
