Urgent - Is OLD EXPIRED I-797 required for filing petition ?
Hi,
My H1B tenure (spanning total 5+ years, after one extension) expired few years back. I had returned back to India before the expiry date.
This is 2nd time my new different employer will be filing my fresh H1B . The employer is asking for a copy of full page I-797 I possessed (old/expired). I only have the counterfoil ORIGINAL with I-94 printed on it, which I have submitted. I do not have original or copy of full page.
Is old I-797 required at the time of filing petition? Will the original counterfoil (with expired I-94 number) be sufficient for filing?
Please note that I am not talking about fresh I-797 and visa interview. It is about filing and attaching old I-797 counterfoil.
