  • H1-B Third Year renew

    hello all,

I am planning to visit my country and renew my H1-B Visa Stamp in this summer. But I have a question about the H1-B first three years gap.

I got my first H1B petition approved in 2012 and the valid date is from 10/01/2012~09/20/2015. Also my visa stamp on passport is valid until 09/20/2015.
Last summer, I transfer to a new company and got a new H1B petition filed by new company. The valid date is from 09/11/2014~07/29/2017.
I am wondering if I need to renew my H1-B again this year to match H1-B first three year period. Or I can just use the petition I got last year and renew my visa stamp.
Also, if I don't need to apply a new petition this year, I will only use 5 years on my H1-B.
What can I do for the sixth year after my current petition expire?

    Thanks

Use the 9/11/2014-7/29/2017 petition to get a stamping, you will get a H1 stamping till 7/29/2017. Towards reaching 7/29/2017, preferably as early as 2/1/2017, ask employer to file extension for the 6th Year. Also, if you are planning to stay beyond 6th Year, advisable to get your GC started by the 4th year itself of course your employer has to agree to that.

This is my opinion not legal advice.
