H1 Petition expired. Can I apply again through Cap Exempt

Hi All,

Need your advice here.

- My H1 visa was filed in may 2007
- H1 Visa issue date - Oct 2007
- H1 Visa Expiration date - June 2010
- Petition Expiry date as per the Visa stamp - June 2010
- I was in US on this H1 b from 2008 to 2009.

Can I apply again now using Cap Exempt?
