  • H4 EAD (few questions)

    Hi:

I am on H4 status. My spouse is on H1B and has an I-140 approval. I am about to apply for EAD. As lawyers here (Los Angeles) are charging humongous fees, I am applying it by myself.

I have few questions regarding the process.

    1) In Form I-765, Question 16: Who may file form I-765, what should I put? (http://www.uscis.gov/sites/default/f...form/i-765.pdf). One of the immigration forums, someone mentioned to use (c) (26). But I don't even see this category listed anywhere in USCIS filing instructions (http://www.uscis.gov/sites/default/f...i-765instr.pdf).

    2) Do I have to pay the Biometrics Services Fee?

    3) I was told that Form I-765 would be revised by the USCIS after the H4 EAD law has passed. But the form looks the same as before ((http://www.uscis.gov/sites/default/f...form/i-765.pdf). In one of the immigration lawyers website, I downloaded the form I-765 and they had a new field which is "18. If you entered the eligibility category (c) (16) above, please provide the receipt number of your H-1B principal spouse's most recent Form I-797 Notice of Approval for Form I-129". Do I have to wait for the form update or can I just print the current form from the USCIS website and send it? (They will start receiving applications from May 26).

    4) Also, 2 photographs are required with the submission. My friend tells me to write I-94 number on the back of the photo in pencil (Looks like that's what she did whenever she sends the photos to USCIS). Can I do this? There is no mention of this in USCIS instructions.

    5) I live in California. To what address do I send the forms?

    Thank you in advance.
