  • Gap of 2 days during change of employers

    Hi,

Can you please help me understand if there is any problem in my situation below like being OutOfStatus or other problems that might be problematic in my future extensions or GC processing.

    My Scenario:
Last day at Company A was Aug 29, 2014. But I started job at Company B on Sept 4, 2014 (Aug 30, 31 and Sept 1 are long-weekend). Ignoring the long-weekend, I have a 2 day gap between the two jobs.

Note: H1 approved date with Company B on Aug 11, 2014.

    Thank You.

Company A: paychecks are twice a month
Last Pay Period: 8/16/2014 - 08/31/2014 (as per the paycheck)
Last Paycheck received date: August 29, 2014

      Company B: paychecks are biweekly
First Pay Period: 08/31/2014 - 09/13/2014 (as per the paycheck even though I was not paid for August 2nd and 3rd)
First Paycheck received date: September 19, 2014

I believe you meant you were not paid for Sep 2nd and 3rd. Such a short out of status period may be ignored by USCIS, but it depends upon the officer.

This is my opinion not legal advice
