    Hi,

    I don;t know if this has been posted, tried searching but couldn't find any question having similar situation. Please advice on this.

    Current Employer A - (Visa Stamping Valid till Nov 2015)

    New Employer B has already initiated Premium transfer (I have the receipt number).

    Situation: I need to go to India by June 16th. Employer B is saying to take leave from current employer, come back, put down papers and join them.

    Case 1: Suppose new petition from B gets approved before I travel to India (June 16th). I am assuming it will have a validity effective from the day its approved.
    Now if I travel to India and come back on my current Employer A's petition ( have to use that only since I will resign and start working for B only after coming back), Will it null and void the already approved petition from B as my last action was using A's petition (which has the validity only till Nov 2015)


    Case 2: Same situation as above, but if the approval for B comes sometime when I am in India, then will my entering in USA based on A's petition cause this to go null and void.


    From what I have read, if B's petition validity had been a future date (e.g. in case of extension), then there would have been no issues. But I think when going for transfer, it will be immediate as of date of approval.

    If anyone has been in this situation, pls help.
