  • :) What is the recommended visa to an immigrant IT Specialist?

Hi to everyone, hope you are doing well.

I could reach you because was doing my researches regarding immigrant skilled worker around the world, once I was born in Brazil and, hehe, I am not actually intended to get marriage for stuff facilities.

My sister got married in Los Angeles 2 years ago and I want to live closer to her.

I am IT Specialist with 11 years of experience at IBM and Hewlett-Packard, with undergraduate diplom in brazil and 13 IT Certifications. My site is Igor IT Specialist | Support, Services & Programming. .

    I already have B1, B2 and F1 visas.

What about H1B, Igor? Have you read about it? I have struggling looking for a job that is able to sponsor, but once not present in US it comes to be more complex to get one. Otherwise, the headhunters sends me job offers according to my profile daily. I have been using Monster Jobs - Job Search, Career Advice & Hiring Resources | Monster.com to that.

And what about Eb-3? I have been reading this one too Employment-Based Immigration: Third Preference EB-3 | USCIS

I have heard a lot about incorporate a company in Delaware, and afterwards to fill I-140 form petition to get work permit in US. Well, I am not sure if it is possible though.

I wonder if I am able to apply to an specific visa that allows me to work and live legally in US? I can arrange my documents of references's experience and education to accomplish that.

What actually would you recommend to me? What is the "easiest way for a profile like me"? There are many visas and it has been 2 years of researches.

    Best regards

    Igor

H1-B or EB-3 if you need a job (ie where someone else generates the revenue with which to pay you a salary).

Your own business can sponsor your visas if your business has the ability to pay you the prevailing wage. If you have the means to do that, you should also consider the EB-5 investment visa which gives your business the benefit of not having to fund your salary draw.

Your sister can naturalize after three years of permanent residency, and then petition for you, but you'll have to wait another 13 years for an immigrant visa.

      Sure.

I understood that an incorporation in Delaware, for example, allows me to make a petition to myself. Is that?

In this case, I suppose I would need an evidence of investiment of the average of 500.000 to 1 million of dollars. If that is true, unfortunately nowadays I do not have that money yet.

That is very interesting. I did not know that. May you recommend me some reference to read?

Keep in mind H-1B is subject to a lottery that is oversubscribed by a factor of four. Because EB-3 employers can't treat you like an indentured slave like a H-1B employer can, they are loathe to spend the money on this process for new employees.

Yes but the entity must show audited financial statements (or a years worth of bank/brokerage statements) showing an ability to pay your salary while remaining a going concern. That may not be possible given your next comment.

Plan on starting your business in a rural or high-unemployment area so that you only need $500k + legal fees.

I really appreciate your attention, thank you.

Well, I have read again our conversation, and I realized to get a visa declaration for EB-3, arrange the documents and schedule an appointment at consulate, in a foreign country. Would you know if it will works once I am not at US territory?

IBM is a large global company. I am sure they have an internal immigration team on their payroll who would be able to determine the best course of action.

This is my opinion not legal advice.

If you want to prepare for the application process than what things you should need of. To get a Brazil visa, you do not need too many documents. Here is a list of several things you must require:
                  Valid Passport
                  Copy of your passport
                  Valid email address
                  Means of payment
