  • Travel from India To USA before 25 days of Visa Expiry

    Hi All,

Currently I am in USA, My visa is valid till 11th Dec 2015 and I am planning to travel to India on vacation from 15th Oct 2015 to 15th November 2015.
I will be back in USA on 15th November that means before 25 days of my visa expiry , So is that will be any problem on port of entry at the time of traveling back to USA from India ?
My employer is going to fill my H1 extension once I back from vacation that means after 15th November, Is that possible if I request my employer to fill the extension now and then I can travel in Oct to India but in this case I dont think I will get I797 till OCt.

    Please provide your valuable suggestions.

    Thanks.

    That's fine, either way.

So is it fine if I travel back to USA from India prior 25 days of my H1 B visa expiry and fill H1 extension once reach to USA that means after 15th November ?
I can not fill my extension now before travel to India because once I back my I-94 number will get change.
      Please elaborate.
      Thanks.

I can not fill my extension now before travel to India because once I back my I-94 number will get change. -- You can file extension in premium, so that you will get it before leaving. On returning make sure you show the new petition and your new I-94 will be according to extended petition.
        Please elaborate.
        Thanks.
        See above.
