Am I eligible to apply H1B VISA under H1B Cap exempt category ?

Friends,

My H1B VISA status : Expired [ Validity 08-Dec-2008 To 13-Sept-2011]
Time Spent in US : 10 Months
Employer who filed my Petition : L&T Infotech
Petition Revoke Status : Not Sure/Don't Know

New Employer : Cognizant

Want to travel to US now. Am I eligible under H1B Cap Exempt category? How to check whether my previous employer revoked my H1B petition ? If Petition is revoked, Can I still apply under H1B Cap exempt category (options)? OR I need to file fresh petition subjected to H1B CAP.

I will appreciate urgent help here.
