H1B transfer for the cancelled visa while in india

Hi All,

I need help from the experts on this forum on below things:

I was working in US on H1B visa and I had to travel back to india in January 2015 and My Employer cancelled my H1B visa petition. But my H1B is still valid until September 2016.

And during this time in April 2015 I joined a new employer in india which is US based company. My new employer is ready to transfer my H1 visa but I have few questions.

Can my transfer be done in premium processing on the same petition or do I have to go for cap in April?

Can I travel to US on existing stamped valid visa or Do I have to get approval done and then get my visa stamped again for new employer?


would really appreciate if you could guide me with few options.

>>> You can go for premium processing. No need to go through new quota.

>>> You can use the existing valid H1B visa to travel. Your will need the petition to be transferred though.
