  • Visa Petition Approved in PP but documents not received since 2 weeks

    Hi,

My unused & unstamped H1 petition (lot picked on 2014) was transferred by new company in Premium Process. It got approved in 15 days but the status shows "Case Was Approved And My Decision Was Emailed" since 2 weeks.

Any idea what is the timeline these guys will take to send them to my Attorney/US Office..?

    Thanks, Mjay

If it is a premium processing case, then an email containing the approval notice or denial notice or an RFE will be sent to the attorney immediately upon a decision is made (at least in most cases). The hard copy of the decision will take about 2 weeks.

Thanks Shervin. My approval happened on September 16, 2015 so I guess the 15 day count should end on 30th Sep. I guess I can expect it anytime after this date. Keeping fingers crossed..!!

Since it is a premium processing case, the lawyer can call USCIS and request them to send a soft copy if they haven't received it already.

          Hi Shervin,

Is there anyway that I can know when or if the docs had been sent to the Attorney. I mean will there be a status change from "Case Was Approved And My Decision Was Emailed" status to some other in the USCIS Website?

          Thanks, Mjay

There will no other status change. Knowing that from your attorney / employer is the only option.

Notice Was Returned To USCIS Because The Post Office Could Not Deliver It

              Hi Shervin,

I got an update on the mobile app I use to know for any updates that:

              -------------------------------------------------------------------------------------------------
Notice Was Returned To USCIS Because The Post Office Could Not Deliver It

On October 2, 2015, the Post Office returned a notice we sent you for your Form I-129, Petition for a Nonimmigrant Worker, Receipt Number EAC YYYY YYYY ZZZ, because they could not deliver it. This could have a serious effect on your case. Please go to www.uscis.gov/e-request to request a copy of the notice immediately. If you move, go to www.uscis.gov/addresschange to give us your new mailing address.
              -------------------------------------------------------------------------------------------------

I suppose being an Indian company OCT 2 was a holiday and so. I could not guess any other reason.

              1) What the next action my employer is supposed to take?
              2) What is the timeline when the USCIS could resend my documents again?
              3) Any serious effect on my case as mentioned in the clause?

              Thanks, Mithun

Ask your employer or the company attorney to talk to USCIS. They will resend the package back.

Thanks Shervin. I asked my employer about what next to what they replied as:
                    -------------------------------------------------------------------------------------------------------------
On October 6, 2015, we contacted USCIS customer service to determine why a notice was returned to them as undeliverable. The officer initiated a service request, and we should have a response back as to why it was undeliverable on October 2, 2015.
                    -------------------------------------------------------------------------------------------------------------

                    Few Questions:

                    > This statement doesn't state that they have asked or been promised to resend the docs but I believe that should be understood as service request to resend. Am I right?

                    > How long does it take it to deliver the package back? (I read somewhere that it would take 2 weeks for them to resend after a service request )

                    Thanks!

                      >>> Yes. The employer should open a service request and ask USCIS to resend the package back.

                      > How long does it take it to deliver the package back? (I read somewhere that it would take 2 weeks for them to resend after a service request )
                      >>> It takes about 2-3 weeks from receiving the SR.

                          Hi Shervin

I got an update from the uscis website that they have approved it again and shows the date of 21 October as the approval date rather than the earlier original one. They have mentioned that they will email the notice. Do you think it will take another two weeks for them to send it again to my Attorney.?

                              Hi Shervin,

My petition got returned again (for the second time form PO to USCIS). I am worried reading the below email that I got from the consulate. Please go thru and advice me on why it went to initial review again and regarding what they say that it could have serious effect on my case and whatever is given below which sounds like I will have a difficult time with my H1B stamping.

Is there any chance for this unfortunate events to end with the cancellation of my H1B petition or something like that.? My immigration consultants at office is of no use. They have no idea nor do they convey the details. I'm worried.

On November 9, 2015, the Post Office returned a notice we sent you for your Form I129, PETITION FOR A NONIMMIGRANT WORKER, Receipt Number EAC15 YYYY YYYY , because they could not deliver it. The timing of your appointment is determined by the number of applicants ahead of you that also need a biometric appointment. We try to schedule biometric appointments as quickly as possible and in most cases you will receive your appointment notice within 30 days of submitting your application. We will send your appointment notice approximately 14 days ahead of your scheduled appointment. It is important that you keep this appointment. If absolutely necessary, you can request that your appointment be rescheduled however, please be aware that rescheduling may delay the processing of your application. Please follow the instructions on your appointment notice if you need to reschedule. Occasionally, you may receive an appointment notice to appear at an Application Support Center to have your fingerprints taken when you have filed a form other than those listed above. In these situations, you may receive your appointment notice more than 30 days after submitting your application or petition.
