  • H1 Stamping in Canada--Fresh 2016

    Hi All,

    I need your help in my complex scenario.

    My Wife is on L1 B visa and I am on L2 with EAD. I am currently working in US with an EAD.

    I have an H1B petition approved which be valid from 01 OCT 2015.
    I am working for the same employer who filled my H1B Since July 17th. I have pay slips and client letter.

    This is a fresh application. I have never been on H1B before.

    Now my query is :

    1) I have heard that in case of fresh application you have to get your H1B stamped from your home country. Is it true?
    2) If not can I goto Canada to get my stamping done?
    3) What will be the procedure?
    4) How many days ii wil have to stay in Canada?


    I will appreciate a quick response. Thanks in advance .

    >>> You can go. But be prepared to stay longer in case there is a 221g issued for admin processing because they could not validate your academic certificates there. That is the main reason why the 1st time stamping should be from your home country. 221g can take anywhere between a couple of weeks to few months. It is case by case basis.

      Thanks for the reply....sorry i forgot to mention..i was in US from 2009 to 2014 on L1 B.
      even now they will verify my educational degrees?

        Yes. L1 is a different process all together.
