URGENT : H1 B Job Termitated, While Spouses H4 to H1 transfer is in process

Since your change of status was filed before your spouse's H1 status ended, you are fine.

However, your spouse will be out of status after last day at work. Any change of status or extension must be filed before last day at work. So your spouse will have to leave the US. He will remain cap-exempt, so if any other employer files H1 petition for him, he can return using that petition. His employer must pay for ticket to home country because they are terminating him earlier than H1 end date.

Hi,

My Spouse is on H1 B visa. I was on H4 visa ( held H1 before and I-140 approved) and now I got a job and my H4 to H1 visa transfer is in process. I will get the result mostly this week and my joining date is Oct 26th. Today my Spouses job got terminated, I want to know how it will impact my H1 transfer.
Does my Spouse have a grace period to find a new job and transfer his H1B to a different company?

Do we need to leave the country immediately? OR do we have some grace period?
