    Hello Friends,

    My H1B expiry date ( after all gaps captured in 6 years): May/07/2014
    My perm filed on Nov 24th 2013 and got audit in Aug 2014.
    I exited the country on Feb/18/2014 . So, technically I have 77 days left in 6years quota.
    My perm approved sometime in June 2015 and my employer not filed I-140 till now ( coz he file i140 only if I get a project).

    Now, I got the project in U.S and have to apply for extension. What are possibilities to get one year extension based on perm approval.

    Or first getting 2months18days of extension ( which were left on 6 years quota) and then applying for 1-140 on premium ?

    What options I have.

    Advisable to file I-140 in premium and get the approval within 15 days and then file the H1B under premium to get a 3 year extension.
    Alternatively, you can recapture the time left in your H1B and enter now and then file the H1B upon approval of I-140 in premium to get another 3 years.
