L2 to H4 COS

Hi, I have recently moved from L1 to H1B, effective 1 OCT 2015. However the L2 to H4 conversion for my dependents was not done by my organization.
They have valid L2 visa ( 6 more months) . Valid I94. I have asked my Organization to file the extension.
1. Are they out of status now ?
2. Whats the risk of H4 being delayed.

>>> Yes. When your company filed your L1 to H1B they should have also filed their L2 to H4.

2. Whats the risk of H4 being delayed.
>>> There are risks with future petition approval and stamping. They are out of status now. You cannot file their COS from L2 to H4 now when they are out of status. The only option is to leave the country immediately, get the H4 visa stamped and re-enter back.
