  • HI COS to H4 EAD

    HI,
    I am on H1B visa now and planning to file COS to H4 and EAD.Please answer below questions

    1. Can i work untill my H4 is approved which will be 2 - 3 months after i file for COS?
    2. How long would it take to get an EAD with COS from H1 to H4, if i file for H4 and EAD together ? will it take 3 months for H4 approval and 3 more months after H4 approval which is 6 months or 3 - 4 months for COS to H4 and EAD from my filing date.

    1. No. You need EAD card in hand to work on it.
    2. Yes 3-4 Months. fastest way to get H4 is to leave US and return on a valid H4 visa. And then file EAD and await. There is no way to expedite H4 or EAD while in US.

      1. Yes, until you get the h4 visa, if you are on h1b, you can continue to work.
      2. 90 days for cos and 90 days for ead is the typical time that uscis states for each.

      From personal experience, it would be a lot faster to get it stamped but in your case, if you can work on the h1b visa, just wait the90 days. Ead usually takes less than a month if toy have all the paperwork.
