  • Change of Status from L1-B to H1-B

    Hi,

I am in the US with Employer A on L1-B status. I have applied for H1-B through employer-B and the employer-B has received the notice that the petition is approved. However, due to certain personal commitments, I prefer to continue to work with employer A.

    1) In this case, is it possible to get the H1-B transferred from employer B to Employer A. Employer B is fine with this. If this is possible, I assume that employer A has to file H1-B petition under cap excempt and apply for change of status. Please confirm if my assumption is correct.
    2) Is it legal to inform Employer A about my approved H1-B or would there be any legal issues?
    3) My L1-B status expires in Sep 2016. Is there any time limit before which the transfer of the petition and change of status should be applied?

Appreciate if you can advice me on this. Thank you.

Was your H1B filed as a COS from L1? Meaning, did the H1B approval come with a new I-94 attached. Answer to all your questions and your current legal status and employment depends on that.
Not a legal advice. Use of this information is strictly at your own risk.
