  • H1B Extension with I-140 Approved But Employer Changed

    I started working with Company XYZ in April 2014.

    1. I have been in US on H1B Visa from October 2008 onwards.
    2. My Previous Company had started my green card filing, and I had received I-140 Approval in July 2011.
    3. Previous Company has not withdrawn the I-140 application. It is still Active.
    4. My Priority Date is October 2010.
    5. My H1B with Company XYZ was filed in April 2014 and is valid from April 2014 through March 2017.
    6. Company XYZ does not do Green Card Sponsorship


    I had two questions/concerns, which if you can help me with, I would greatly appreciate

    1. Can my H1B be extended beyond March 2017 ?Given I have an approved I -140.
    2. Can I pursue my green card application without Company XYZ Sponsoring it ? Given I -140 is still not withdrawn and USCIS revised process that two charts per visa preference category will be posted – Application final action date, and Dates for filing applications (I-485). If application filing date get current
    (i) Can I pursue/continue the same green card application, on my own ? Or because it is an employment based application, it has to be supported by the employer
    (ii) Can I pursue through an employer other than Company XYZ without any precondition attached ?


    I greatly appreciate your help and guidance on this
