  • Can Fresh H1B premium processing upgrade after RFE take long than 15 business days

My Fresh H1 2016 was filed under regular processing. I got selected in lottery.

    I got RFE on September 10, 2015.
My employer says he filed response to RFE/I-129S under premium processing. Today's status is below,

On November 20, 2015, we received your response to our Request for Evidence for your Form I-129, Petition for a Nonimmigrant Worker, Receipt Number WAC15 YYYY YYYY . Our California Service Center office will begin working on your case again. We will mail you a decision or notify you if we need something from you. If you move, go to www.uscis.gov/addresschange to give us your new mailing address.

Today is 12/28 and 24th business day since RFE response was filed and still I see the old status online.

Does it mean my employer did not file under premium?

    Any insight much appreciated.

1 - 3 months by normal process and 15 days by premium. Only your employer can answer it.
