Hello everyone,
I needed help with some COS questions. Here is my situation:
Currently, I am working on my OPT and my OPT expires on May 18,2016. My employer is going to file H-1B in premium process for me. However, I am a little confused about change of status.
1. My husband is on H-1B with a different company. I wanted to apply for COS to H4 if my H-1B does not get approved. If I do not hear back about my H-1B results before May 18,2016, can i continue to work at my current job?
2. Also, till when do I have to apply for COS to H4 so I can legally stay in the US?
3. If my H1B does get approved, how do I go about cap gap extension to continue to work until October 1?
4. If my H1B does not get approved and I apply for COS to H4, can I stay in the US till result is pending?
5. If my H1B does not get approved, till when can I continue to work?
