    I am a Master's student and I am on F1 student visa. I am planning to graduate in March 2016. I am also applying for my OPT with start date in first week of May2016. I will start working for a company from May 2016. The company shall apply for my H1B visa in April 2016. But since I have a long break I am planning to travel outside of the United States to my home country. I heard that the H1B will then need to be processed as "councelor petition".

    Can you please help me understand what this is? I also heard that there are a few consequences for such an application. Please do explain, the process (if approved/not approved H1B). My questions basically are: Can I start working in May, as per my plan once my OPT gets approved, irrespective of H1B visa approval. Can I enter the United States in May with my EAD card (OPT)?

    Any help would be appreciated...
