Reapply H1 after completion of 6 years

hi,

i have completed 6 years of H1.and then overstayed for 1 more year trying to transfer to F1(student visa). my F1 was not approved. so i left USA .

i have heard that after completion of 6 years of stay of H1 in USA you need stay 1 year outside of USA to reapply for H1


i have stayed 4 years outside of USA and am planning to apply for H1 again.

my question is
Am i eligible for H1 and does my overstay in USA create any problems

Your overstay by 1 Year can cause problems. Would suggest you take guidance from an attorney.

is it not true that once i apply for any visa before expiration of old visa, i could stay in US legally while waiting for the new visa to be approved
