  • Cap exemption after expired petition

    Hi
I was selected in 2015 H1 lottery process. My H1 petition is valid till Dec 2016 but I am not sure if I can stamp my visa before that. Can anyone please let me know if I still need to go to the lottery process next year if I do not stamp my H1 before Dec 16. Also, is there any time frame within which I need to stamp my H1, e.g. as my petition is valid till Dec 2016, I need to stamp it before Sept/Oct 2016 for better chances?

Thanks a lot for your help!

No, you don't have to go through lottery process again for the next 6 years.

Of course, your new employer will have to file new H1 visa petition.
This is not a legal advice. Use at your own risk.

Thanks a lot JNK ....my employer would be the same...it just that I am in the UK and my employer wont stamp my h1 this year. I have one more query...if I stamp the visa after petition expiry, will it reduce my 6 year stay period...e.g. if I stamp in Dec 17, do I get to stay only for 5 years? (Sorry, I might be asking very basic que )
