Hi,
Employer A filed fresh H1 in year 2008. Selected in lottery and Petition also approved.
But due to recession, didn't go for stamping.
In year 2014 April, Employer B filed fresh petition under cap exemption. Petition approved, Went for stamping,
but got 221g in chennai consulate. The case was referred back to USCIS kentuky for review.
There is no update for past 1.5 years. Employer says he has also not received any inquiry and he is not ready to withdraw.
All this happened while in India.
My question, is can a new employer C, file a petition based on cap exemption.
The first petition crossed 6 yrs. The second petition stuck in 221g. Does this second petition has 6 years cap exemption starting from 2014 ??
Does employer C, can file new petition based on this ?
