  • L2 to H1 conversion in "Out of country" case

    Hi,
    I am on L2 EAD and my employer is filing my H1B in normal processing. I have plan to travel India in May 2016 and will back in June 2016. Attorney said that thay can file my H1B in "Out of country" case and in Normal processing and it will not effect my travel as well as my case with uscis. is it possible? Please advise.

    It means same as "consular process" So you would not move to H1 status from H1 start date, you would have to continue to work on L2 EAD after your re entry.
