Expired H1 stamped, but never travelled to US, can we consider it for CAP-Exempt

Hi,

I was having H1-B visa approved & stamped with validity 2001-03. But I never used it and travelled to USA. Now in 2016, I came to USA on B1/B2 visit visa for a short trip.

Can I use my expired H1-B visa and apply for new H1-B under CAP-Exempt. Can you please guide me on this?
