  • Form I-539

    I am filling form I-539 to extend my daughter's I94 date and I need some help in filling it.

    Case -
    1. My I94 date is 11/08/2017
    2. My daughter I94 date is 06/13/2016 as her passport is expiring on that date.
    3. I have renewed her passport and new passport expiry date is 02/15/2021
    4. I want to extend my daughter's I94 date to match with mine.

    Question -
    1. I am filling I539 and I do not see any field which asks for new passport details ? How USCIS will associate new I94 date with her new passport ?
    2. As she is minor , do I need to send my financial documents to show she is financially dependent on me ? (Item # 19 in part 4)

    Did you try getting a new I-94 by reaching out to the local CBP office?

    1. I would suggest adding a cover letter explaining the need for extension as passport was expiring.
    2. Yes. Pay stubs for last three pay period and 2015 W2 should suffice. Below is a Checklist:

    Add a cover letter on top of it.

    1. Form I-539
    2. Check for the filing fees
    3. Current I-94 for your dependent.
    4. Current I-94 for parent.
    5. H4 visa Copy.
    6. New Passport Copy.
    7. H1 Visa Copy.
    8. Birth Certificate for dependent.
    9. Your I797 copy .
    10. Pay stubs for last three pay period and 2015 W2.

      This is very concise answer and I will do the same.I did visit local CBP ( san francisco) office but they told me to fill I539.
