  • H1 Transfer beyond 6 years

I have been working in the US for 6 years.
My employer filed my I-140, which was approved. They also filed for an extension of my H1B based on the I-140, which was also approved.

    My situation is as follows:

    Original I-797 expiration: Sept 30, 2016
    Extension I-797 start date: Oct 1, 2016

Meanwhile, I have received an offer from another company. Will I be able to transfer to the new company before Oct 1, 2016 without jeopardizing my H1B extension or I-140 filing (I don't want to lose my priority date)?

    Thanks!

    Of Course

As long as you have an approved I-140, you can change employers. But make sure when you file your extensions with your new company that your I-140 is still valid and that it is still in the same line of work that your I-140 was approved under.
This is purely my opinion and does not constitute legal advice.
