  • H1-B Restamping

    Hello,

    I have a question on H1-B Visa re-stamping.

In my passport, I currently have my stamped visa (based on my previous employer’s H1-B) which is valid until 13th January 2017.

I have new employer's I-797A H1-B Approval Notice which is valid until 17th April 2019.

I have a vacation plan in Sept 2016 and will be returning to US on 25th September 2016.

    • In this case, do I need to go to the US Consulate for my VISA re-stamping based on my new employer's I-797 ?

    • Or can I make an entry into US using my current Visa which is valid until January 2017 ?

Could you please help me to get these queries clarified.

    Thanks in advance,
    Prasanth.

Technically you need not, but upon re entry the officer may give you I-94 only till Jan 2017 citing that your visa is only till then.

This is my opinion not legal advice.
