  • H1-b REVOKED - Out of status for 50-60 days

    Hi everyone,

    My H1b got revoked on July 22nd. Last employment date is 1st July.
    My new employer is applying for H1 on Aug 5th.

    That means I will get new H1 by Aug 25th or 30th.
    That will make me out of status for 60 days.

    What will be the consequences of staying out of status for 60 days?
    Please let me know..

      If next employer provides enough documentation their petition may still get approved. But in most likelihood it will eb approved as consular process, that is you would need to leave US and re enter on a valid visa and show the next employer's petition. If your visa has expired, then you need to get yourself a new one before re entering.

        I have visa stamped till Aug 2018. So should it be ok for me just to leave the country and come back?
        Or should I get new stamping as this is a new employer?

          If I 797 is approved as consultar process, you can leave and re enter.
