Hi All,
I had a H1 from employer A in 2012 and traveled to US also. After coming back to India, I joined employer B (current employer) in 2014. They filed an out-of-cap petition in Feb-2016. The petition is not yet approved.
Now, I have an offer from employer C, but I'm in a dilemma as the out-of-cap petition filed by my current employer is still in-progress.
I have the below questions given the above scenario.
1. Will the petition be withdrawn by my current employer, if I resign?
2. Will it impact my future out-of-cap H1 petition approval, since there is already a withdrawal against my H1? I have the out-of-cap eligibility till Jun-2018
Please advise.
