Hi,
I am in a very tricky situation and need some expert advice.
I am currently working for Employer A and have my I797 petition approved until Dec, 2017. My visa is also stamped via same petition. I received an offer from Employer B and they filed my H1B and i received the new petition from them which is approved until Nov, 2018. I have some holidays planned in October to travel to India which i am planning to go from Employer A (as i have Earned Leaves pending) and planning to give 4 weeks notice to employer A after coming back from India and then Join Employer B. I have few questions here -
1. When i am coming back, on POE do i need to show Employer A petition or Employer B. I am planning to work for Employer A for 4 weeks (notice period) before Joining Employer B.
2. If i will show Employer A I797, i presume my new I94 will be with Employer A. In that case can i join Employer B with the valid I797 (that i received before going on vacation) or this process will invalidate that I797?
